We beg again to refer to the lemorandum of Collateral Agreement between Che. J. Goupy & Co. and the Hongkong and Shanghai Banking Corporation dated 12th. August and lat. September, 1914,
a copy of which was forwarded to you with our letter of 14th.
June, 1915.
We enclose a copy of a letter addressed by us to the
Hongkong and Shanghai Banking Corporation under date of 20th.
August, 1915, which, we understand, the Bank have already shown
you.
It appears to us that we must carry out the strongly
expressed desire of the British Crs litors to question the
validity of the Collateral Agreement especially in view of Mr.
Potter's opinion of which a copy is enclosed.
We should thank you to advise us what course you
consider we should adopt to obtain the directions of the Court in
the matter.
We presume that Section 6 of the Alien Enemies (Winding up) Amending Ordinance ap lies to the present situation.
